Restraining Order Spells Relief for Laker’s Star
October 7, 2008 by tgabeh
A Los Angeles woman was arrested Monday for allegedly stalking Luke Walton, the Los Angeles Laker’s basketball star. The arrest triggered a temporary restraining order to keep the woman away from Walton. There is a Nov. 6 court date. If the woman is found guilty of stalking, at the very least that restraining order could become permanent. For Walton, it would finally mean relief from an over-aggressive fan.
For the rest of the non-famous population, a restraining order can be a legal shield to protect potential victims from crime. A restraining order is an order made by a court to protect a person from physical pain or injury or the threat of pain or injury. It can generally be issued against a family member, a household member, or against someone you have recently dated. A restraining order can also be issued against any person who threatens to harm you in any way. Marriage is not a prerequisite to obtaining a restraining order. However, you must know where the person lives or works.
A restraining order “orders” the potential offender to stop hitting, threatening, or harming you in any way. It can also order the person to stay away from you, to move out of your home, or to stop coming to your home. The person can be arrested if he or she violates the terms of the restraining order.
If you are being physically threatened by another person to invoke pain or injury to you, you should invoke the power of the courts to issue the protection of a restraining order against that person. You should contact the attorneys at Houston & Blanco to help you make sure your legal rights are protected. Alternatively, if you have been charged with violating a restraining order, your rights are in jeopardy and you need to seek the assistance of counsel immediately.
